# astreinte vs pénalité : quelle nuance ?

Astreinte vise à contraindre un débiteur à exécuter une obligation judiciaire par le paiement d'une somme par jour de retard, tandis que pénalité vise à sanctionner l'inexécution d'une obligation contractuelle par une somme forfaitaire prévue au contrat.
